1. Agreement
These terms are an agreement between you and ENB Technologies Limited (“ENB Technologies”, “we”, “us”). By using our website, buying from us, booking a service or creating an account on our marketing platform, you agree to them. If you use our services for a business, you confirm you are authorised to accept these terms for it. Our Privacy Policy explains how we handle personal information.
2. Terms for all services
- Quotes, prices and delivery times are given before work or payment. The quote, invoice or order confirmation you accept forms part of your agreement with us and takes priority over these general terms if they differ.
- Prices are in Nigerian Naira unless stated otherwise and include the taxes shown on the invoice.
- Please give us accurate information and keep your contact details up to date so we can reach you about your order or account.
- Nothing in these terms limits your rights under Nigerian consumer protection law, including the Federal Competition and Consumer Protection Act 2018.
3. Repairs, data recovery and IT support
- We diagnose first and tell you the price and expected time before any repair. We only go ahead with your approval.
- Please back up your data before handing over a device. Repairs can involve replacing storage or reinstalling software. We take care with your files, but we are not responsible for data loss that happens despite reasonable care, or that was caused by the existing fault.
- Remove passwords, SIM and memory cards you don’t want us to handle, or tell us the access we need for testing. We only access your device as needed for the job (see our Privacy Policy).
- Parts we fit are genuine or of equivalent quality, as agreed in your quote. Any warranty on the repair or parts is as stated on your quote or receipt.
- We will contact you when your device is ready. Please collect it, or arrange delivery, within a reasonable time.
4. Computers, accessories and software
- Products are described as accurately as possible; the specification on your invoice is what you buy. Manufacturer warranties apply as stated by the manufacturer and on your receipt.
- Software licences are genuine, and are governed by the software publisher’s licence terms, which you accept when you install or activate them.
- Please check items when you receive them and tell us about any fault or missing item promptly.
5. eSIM plans
- Check that your device supports eSIM and is not carrier-locked before buying. The store lists the countries, data allowance and validity for each plan.
- Your eSIM QR code is sent by email after payment. Install it as instructed, and keep it private: anyone with the code may be able to install the plan.
- Network coverage and speed are provided by the local networks and can vary. Refund terms shown at purchase apply. If your eSIM can’t be delivered or activated because of a problem on our side, we will replace it or refund you.
6. The email & WhatsApp marketing platform
The platform at app.enbtechnologies.com (the “Platform”) lets businesses manage contacts, send email campaigns, WhatsApp broadcasts, automations and transactional messages, collect sign-ups, and send invoices and receipts.
- Accounts. You must be at least 18 and use the Platform for a genuine business or organisation. Keep your password safe, and turn on two-factor sign-in. You are responsible for everything done through your account, its team members and its API keys.
- Review. New accounts are reviewed before they can send. We may ask about your business, your audience and how you collected your contacts.
- Sending limits. Accounts have daily and monthly limits that protect deliverability for everyone. Limits rise as your account builds a good sending record.
- Your identity. Messages must clearly identify your business. Marketing emails must include your business name and real postal address, and a working unsubscribe link (the Platform adds this for you).
7. Acceptable use
You must follow all laws that apply to your messages. These include the Nigeria Data Protection Act 2023, Nigerian Communications Commission regulations on unsolicited messages and, where your recipients are, laws such as the GDPR, the UK PECR, CAN-SPAM and CASL. You also must not:
- send marketing to anyone who has not agreed to receive it from you, or use purchased, rented, scraped or harvested lists;
- hide or remove unsubscribe options, or keep messaging people who opted out;
- send phishing, malware, scams, deceptive content, or messages that impersonate someone else;
- promote illegal goods or services, gambling without the required licence, adult sexual content, weapons, drugs, hate or violence, or anything else prohibited by the WhatsApp Business and Commerce Policies or the policies of our email provider;
- send promotions through transactional email or utility WhatsApp templates;
- try to get round sending limits, reviews or security controls, probe or overload our systems, or access another customer’s data; or
- resell the Platform without our written agreement.
High bounce or spam-complaint rates can pause sending automatically, to protect your reputation and ours.
8. Plans, payment and renewals
- Plans. Each plan includes monthly email and WhatsApp message allowances, and limits on contacts, team members and API requests, as shown in Settings → Plan & billing. Allowances reset on the 1st of each month and unused messages do not carry over.
- Paying. You can pay by card through our payment provider, or by bank transfer against the invoice we send. A plan starts when payment is confirmed. Paying for 12 months costs the price of 10.
- No automatic charges. We don’t store your card or charge you automatically. We remind you before your plan ends. If you don’t renew within 3 days after the end date, your account moves to the Free plan and its limits. Nothing is deleted.
- Changes. You can upgrade at any time; the new plan runs from the date of payment. Renewing the same plan early adds to your remaining time. We will give at least 30 days’ notice of price increases for existing customers.
- Refunds. Plan payments are for access to the Platform for the period paid. They are not refundable for unused time or unused messages, except where the law requires, or where we could not provide the service because of a fault on our side.
- Third-party fees. Meta charges its own fees for WhatsApp template messages. Unless we tell you otherwise in writing, Meta bills these to the WhatsApp Business account you connect. They are not included in our plan prices.
9. API
- API keys give access to your workspace’s data. Keep them secret, give each key the lowest role it needs, and revoke keys you no longer use.
- API requests are limited per minute and per day by your plan. Messages sent through the API count towards your plan like any other.
- The transactional email and WhatsApp endpoints are only for messages the recipient expects about their own order, booking, account or request. They are not for marketing.
- We may change or add API features. We will give reasonable notice before removing features you rely on, unless the change is needed for security or legal reasons.
10. WhatsApp
- You connect your own WhatsApp Business number through Meta. You must accept and follow Meta’s WhatsApp Business terms, and the WhatsApp Business and Commerce Policies.
- Only message people who gave you their number and agreed to hear from you on WhatsApp. Start conversations with approved templates only, and honour opt-outs straight away.
- Meta decides which templates are approved, the number’s messaging limits and its quality rating. It may restrict numbers that receive poor feedback. We are not responsible for decisions Meta makes.
11. Your data on the Platform
- You own the contacts, content and data you put on the Platform. You give us permission to store and process it only to provide the Platform to you.
- For personal data of your contacts, you are the controller and we are your processor. We process it only on your instructions, keep it confidential and secure, use only the providers listed in our Privacy Policy, and help you respond to people’s data requests. When your account closes, we delete it as described in our Privacy Policy.
- You confirm you have the right to upload your contacts and to message them, and that you have given them any privacy information the law requires.
- You can export your contacts at any time.
12. Suspension and closure
We may pause sending, suspend or close an account that breaks these terms, puts other customers or our sending reputation at risk, doesn’t pay, or where the law requires. Where reasonable, we will tell you why and give you a chance to fix the problem first. You can close your account at any time by contacting us (see Data Deletion).
13. Intellectual property
The Platform, our website, templates and branding belong to ENB Technologies or its licensors. You may use them only as part of our services. You keep all rights in your own content. If you send us suggestions, we may use them without any obligation to you.
14. Warranties and liability
- We provide our services with reasonable care and skill. Except as stated in these terms or required by law, the Platform is provided “as is”. We don’t guarantee that every message will be delivered, opened or free of delay, because this depends on email providers, networks and Meta.
- We are not liable for indirect or consequential losses, such as lost profits, revenue, data or business opportunities.
- Our total liability for any claim about the Platform is limited to the fees you paid us for the Platform in the 12 months before the claim. For other services, it is limited to the price of the service or product concerned.
- Nothing limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
- You agree to cover our reasonable losses from claims caused by your messages, your content, or your breach of these terms or of the law.
15. Governing law and disputes
These terms are governed by the laws of the Federal Republic of Nigeria. If there is a problem, please contact us first and we will try to resolve it quickly. If we can’t, the courts of Lagos State, Nigeria, will have jurisdiction.
We may update these terms. We will post the new version here with a new date and, for significant changes affecting Platform customers, tell you at least 14 days in advance. If you keep using our services after that, you accept the updated terms.
